Medicolegal reports may be requested by companies or private solicitors.
Reports are based on a psychiatric assessment conducted via telehealth, as well as a review of medical files and other relevant documentation.
All telehealth medicolegal consultations are audio-visually recorded and securely stored at the practice. Recording assessments in this manner is emerging as best practice in medicolegal settings.
Audio-visual recordings serve as a safeguard for both parties by providing an objective record of the assessment. This supports clarity and accountability if there are any disputed allegations regarding the content, the doctor’s conduct, or the assessment proceedings. The purpose of the audiovisual recordings is quality assurance of the interview process. Recordings are designed to remain securely stored at the practice unless a complaint is made about the assessment.
The Medicolegal report addresses a patient’s psychiatric history and mental state only and is designed to answer any specific questions asked by the referrer.
Patients can only be assessed if they voluntarily consent to the assessment. No assessment can be conducted without the individual’s written consent.
Types of Medicolegal Reports provided include:
- Fitness for duty
- Mental illness defence
- Medical negligence
- Psychiatric consequences of dust exposure
- Psychiatric consequences of bullying and harassment
Types of Medicolegal reports NOT provided.
Eastern Suburbs Psychiatry does not provide WorkCover reports or Motor Vehicle Accident Reports.
Eastern Suburbs Psychiatry does not provide Medicolegal reports for Australian Government benefits (including NDIS), payments, pensions, housing or any other support services. Medicolegal reports are only issued when a third-party solicitor formally refers a patient. General letters are not provided for Court purposes.
Reports will not be issued if you are acting as your own legal representative.
